Terms of Service — GearKart

Welcome to GearKart. By accessing or using our website gearkart.com (the "Store"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before placing an order. If you do not agree to these Terms, please do not use our Store.


1. Account Terms

  • You must be at least 18 years of age to create an account or place an order on GearKart. By using our Store, you confirm that you meet this requirement.
  • You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility.
  • You agree to provide accurate, current, and complete information when creating an account or placing an order. GearKart reserves the right to suspend or terminate accounts where false or misleading information is provided.
  • You must notify us immediately at support@gearkart.com if you suspect any unauthorised access to your account.
  • We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe a violation of these Terms has occurred.

2. Pricing and Payment

  • All prices displayed on GearKart are in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
  • We reserve the right to change product prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.
  • We accept the following payment methods: UPI, Credit/Debit Cards, Net Banking, Wallets, and Cash on Delivery (COD) where available.
  • For prepaid orders, payment is processed securely through our third-party payment gateway. GearKart does not store your card or banking details.
  • In the case of a payment failure, please ensure your payment has not been debited before retrying. If an amount is debited but the order is not confirmed, it will be refunded within 5–7 business days automatically.
  • GearKart reserves the right to cancel any order where a pricing error has occurred due to a technical glitch or human error, and a full refund will be issued in such cases.

3. Product Descriptions

  • We make every effort to display our products as accurately as possible, including images, descriptions, dimensions, and specifications.
  • However, we do not warrant that product descriptions, images, or other content on our Store are completely accurate, complete, or error-free. Colours may appear slightly different due to screen display variations.
  • Product availability is subject to change without notice. In the event that a product becomes unavailable after your order is placed, we will notify you and offer an alternative or a full refund.
  • Any claims about product performance, compatibility, or usage should be verified by the customer before purchase. GearKart is not liable for purchases made based on assumed compatibility.

4. Order Acceptance

  • Placing an order on GearKart constitutes an offer to purchase. Your order is not confirmed until you receive an Order Confirmation email or SMS from us.
  • GearKart reserves the right to refuse or cancel any order at any time for reasons including but not limited to:
    • Product unavailability or stock errors
    • Suspected fraudulent transactions
    • Incorrect pricing due to technical errors
    • Incomplete or unverifiable delivery information
  • If your order is cancelled after payment, a full refund will be initiated within 5–7 business days to your original payment method.
  • Bulk orders or repeat orders of the same product may be flagged for review and may require additional verification before processing.

5. Shipping and Delivery

  • GearKart ships across India through trusted logistics partners including but not limited to Shiprocket, Delhivery, and BlueDart.
  • Estimated delivery times:

Tier 2 / Tier 3 cities 5–8 business days
Remote / Rural areas 7–12 business days
  • Delivery timelines are estimates and may vary due to public holidays, weather conditions, courier delays, or other circumstances beyond our control. GearKart is not liable for delays caused by third-party logistics providers.
  • Shipping charges, if applicable, will be clearly displayed at checkout before you complete your order.
  • Once an order is dispatched, a tracking number will be shared with you via email or SMS. It is your responsibility to track your order and be available to receive delivery.
  • GearKart is not responsible for failed deliveries due to incorrect address details provided by the customer. Re-delivery charges, if any, will be borne by the customer.

6. Returns and Refunds

We have a simple and fair return policy — please read it carefully.

What is eligible for return:

  • Only products that are received in a defective or damaged condition are eligible for return.
  • A defective product means one that has a manufacturing defect, arrives physically damaged, or does not function as described at the time of delivery.

What is not eligible for return:

  • Products that have been used, installed, or tampered with
  • Products damaged due to misuse, negligence, or improper handling by the customer
  • Products returned without original packaging or accessories
  • Change of mind, incorrect selection, or orders placed by mistake
  • Products where the issue is reported more than 48 hours after delivery

Return process:

  1. Contact us within 48 hours of delivery at support@gearkart.com with your order number and clear photographs or a video of the defective product
  2. Our team will review your request within 2 business days
  3. If approved, we will arrange a reverse pickup at no cost to you
  4. Once the product is received and inspected at our end, we will process a replacement of the same product

Replacement policy:

  • GearKart offers replacement only for defective products — we do not offer cash refunds for defective items unless the same product is out of stock
  • If the product is out of stock at the time of replacement, a full refund will be initiated to your original payment method within 7–10 business days
  • Replacements are dispatched within 3–5 business days of receiving and verifying the returned product

COD orders:

  • For Cash on Delivery orders where a refund becomes applicable (out of stock replacement), the refund will be processed via bank transfer. You will be asked to provide your bank account details.

7. Prohibited Uses

By using our Store, you agree not to:

  • Use the Store for any unlawful purpose or in violation of any Indian law or regulation
  • Place fraudulent orders or provide false personal information
  • Attempt to gain unauthorised access to any part of our Store, servers, or databases
  • Use automated bots, scrapers, or crawlers to extract product data, pricing, or customer information
  • Reproduce, duplicate, copy, or resell any part of our Store without express written permission
  • Post or transmit any harmful, offensive, or misleading content through any communication channel on our Store
  • Engage in any conduct that disrupts or interferes with the proper functioning of our Store

Violation of any of the above may result in immediate account termination and legal action where applicable.


8. Limitation of Liability

  • GearKart's total liability to you for any claim arising out of or relating to these Terms or your use of our Store shall not exceed the amount you paid for the specific product giving rise to the claim.
  • GearKart shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
  • We are not responsible for any damage to your vehicle, device, property, or any other asset resulting from the use or misuse of any product purchased from our Store. All product usage is at the customer's own risk.
  • GearKart is not liable for any delays, failures, or disruptions caused by circumstances beyond our reasonable control including natural disasters, strikes, government actions, or internet outages.

9. Intellectual Property

  • All content on GearKart including logos, brand name, product images, descriptions, graphics, and website design are the intellectual property of GearKart and are protected under applicable Indian intellectual property laws.
  • You may not reproduce, distribute, or use our content for any commercial purpose without our express written consent.
  • Product images sourced from suppliers are used with authorisation and remain the property of their respective owners.

10. Governing Law and Jurisdiction

  • These Terms of Service shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and all other applicable Indian statutes and regulations.
  • Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Store shall be subject to the exclusive jurisdiction of the courts located in [YOUR CITY], India.
  • We encourage customers to first reach out to us directly at support@gearkart.com to resolve any dispute amicably before initiating legal proceedings.

11. Changes to These Terms

GearKart reserves the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to our Store with an updated "Last updated" date. Your continued use of the Store after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
